TCPA

The US Telephone Consumer Protection Act, which restricts automated calls and texts and sets statutory damages per violation.

The TCPA governs autodialled calls, prerecorded messages, and text messages. Its damages are per message, which is why class actions under it are expensive: a campaign to a large list can multiply a small per-message figure into a very large number.

Consent requirements depend on what is being sent and to what kind of line. Marketing to a mobile generally requires prior express written consent.

No validation result substitutes for consent. Knowing a number is a live mobile tells you the message can be delivered, not that you are allowed to send it. Our terms put that obligation on the sender, where the law puts it.
